Abstract

Negligence that can result in loss of life is increasingly prevalent in society. Negligence is categorized as a less serious offense than deliberate, but not the same as deliberate negligence. Negligence is more likely to lead to a lack of caution, recklessness, and carelessness. This study addresses the issue of Decision Number 13/Pid.B/2023/PN Sby, concerning the fulfillment of the elements of fault when considering sentencing for the perpetrators of the Kanjuruhan Malang riots. This paper applies normative legal research methods. The study found that the panel of judges, in considering whether the elements of fault were met, based on actual events, which were derived from the perpetrators' testimony. The judges' considerations in issuing an acquittal were deemed to have not fully satisfied the sense of justice for the victims. The purpose of this paper is to determine whether the acquittal of the perpetrator in decision number 13/Pid.B/2023/PN Sby complies with statutory regulations and satisfies the sense of justice for both parties.
