Abstract
This thesis, Legal Analysis of Generative Artificial Intelligence (AI) in Contract Drafting under Indonesian Civil Law, examines (1) whether AI can be regarded as a legal subject in contracts under Indonesian civil law and (2) to what extent AI-produced contracts satisfy the validity requirements stipulated in Article 1320 of the Civil Code. Motivated by the increasing use of generative AI (e.g., ChatGPT) for drafting contractual documents and the resulting legal uncertainty regarding consent, capacity, object, and lawful cause, the study adopts a doctrinal (normative) approach combining statute and conceptual analysis. Primary sources include the Civil Code, the ITE Law, the Personal Data Protection Law, and related government regulations; secondary literature and non-legal materials supplement the review. Qualitative analysis concludes that AI, in its current legal status, cannot be treated as an independent contractual party; rather, it functions as an electronic tool or agent whose use requires clear allocation of responsibility among developers, platform operators, and human users. Recommended measures include normative harmonization, mandatory human review (human-in-the-loop), model transparency and algorithm audits, certified electronic signatures and accountable audit logs for electronic evidence, and further empirical and jurisprudential research to strengthen legal certainty Keywords : Generative AI, contract law, Indonesian Civil Cod
