Abstract
Human trafficking is a criminal offense and a form of organized transnational crime conducted by several individuals across national and international borders. Most victims originate from developing countries experiencing economic change. The ultimate goal of this crime is to force women and girls to work in the sex industry and other forms of economic exploitation for the benefit of agents, recruiters, and criminal syndicates. This illegal activity is often associated with other illicit practices such as domestic servitude, fake marriages, illegal employment, and adoption trafficking. This study discusses legal protection for victims of human trafficking. The research method used is empirical juridical, based on primary data supported by secondary data, which includes primary, secondary, and tertiary legal materials. The data obtained were analyzed using a qualitative descriptive approach. The author concludes that legal protection for victims of human trafficking can be provided in the form of restitution, compensation, and rehabilitation, as well as other legal safeguards. The main factors influencing the effectiveness of law enforcement in human trafficking cases include limited access of law enforcement officers to information—causing reliance on public reports—and lengthy investigation processes due to the complexity of cases and lack of sufficient evidence. Efforts made by the Surabaya City Police (Polrestabes Surabaya) in carrying out their duties and preventive functions include educational and socialization activities involving the community, families, and law enforcement officers, aimed at raising awareness about the importance of protecting victims’ rights. The main obstacle faced by the Surabaya City Police is the lack of public understanding regarding the importance of legal protection for victims.
