Abstract

Identity is a fundamental human right inherent from birth, with names playing a central role in shaping it. A name serves not only as a means of identification but also as a complex social, legal, and psychological construct. It signifies an individual’s existence within a community and is essential for accessing basic rights. In Indonesia, the legal framework allows citizens to change their names through a structured process, primarily governed by Law Number 23 of 2006 and Law Number 24 of 2013. This process is designed to ensure legal certainty while preventing misuse. The motivations for name changes can range from simple administrative corrections to complex emotional needs arising from family dynamics, particularly post-divorce situations. An advocate's role in these sensitive cases goes beyond legal procedure, requiring them to translate clients' experiences into acceptable legal narratives. Observations from an internship at the East Java Regional Leadership Council of the Indonesian Advocates Federation highlighted the interplay between legal rigidity and human experience, prompting a comprehensive exploration of name change procedures in the report titled “THE NAME CHANGE APPLICATION PROCEDURE AT THE SURABAYA DISTRICT COURT BY ADVOCATES OF DPD FERARI EAST JAVA.”
