Abstract

The crime of sexual intercourse involving children, whether as perpetrators or victims, is a complex legal issue in the administration of juvenile criminal justice in Indonesia. Law Number 11 of 2012 concerning the Juvenile Criminal Justice System regulates the treatment of children in conflict with the law, including the application of the principle of restorative justice. In practice, the application of legal norms by judges in cases with similar characteristics often shows significant differences, particularly regarding the ratio decidendi and the choice of legal basis. The two decisions that are the object of this study, namely Decision Number 27/Pid.Sus-Anak/2023/PN Smr and Decision Number 4/Pid.Sus-Anak/2024/PN Kdr, both contain the crime of consensual sexual intercourse, but differ in the judges' ratio decidendi. These differences raise questions regarding the legal basis used, the consistency of the application of the law, and the ideal form of legal protection for children, both as perpetrators and victims. This study uses a normative juridical method. The results show fundamental differences in the use of legal basis by judges in the two decisions. In Decision Number 27/Pid.Sus-Anak/2023/PN Smr, the judge applied Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, arguing that the perpetrator exploited the victim's vulnerability while she was unconscious. Meanwhile, in Decision Number 4/Pid.Sus-Anak/2024/PN Kdr, the judge based the decision on the Child Protection Law because, although the intercourse was consensual, the victim remained a child who was legally incapable of giving consent.
