Abstract

Sexual violence is even classified as a crime against humanity in international law. The variety of sexual acts experienced also varies widely in the social environment, as for sexual harassment, as well as sexual harassment. Anyone can be a victim of sexual harassment, but from social facts often women become a sensitive or vulnerable class of society to abuse their rights and interests. This study aims to explain the fulfillment of the elements of physical sexual harassment crimes and the basis of consideration used by the panel of judges in criminal prosecution in Decision Number 533/Pid.B/2024/PN.Sda. In addition, this research is juridical The case and conceptual approach supported other relevant legal sources in this study by using secondary data sources with qualitative processing as well as legislative approaches, case and conceptual approaches. The main results of the study This shows that the perpetrators in the verdict were found guilty and fulfilled the elements according to the prosecutor's indictment, but did not comply with the principle of lex specialist derogate legi generalis because the panel of judges ruled out special rules rather than rules General.
