Abstract
Debt is a crucial instrument for corporate financing. If a debtor defaults, the Suspension of Debt Payment Obligations (PKPU) mechanism can be used through a court-approved settlement agreement. However, debtors often fail to honor the settlement agreement, resulting in significant losses for concurrent creditors. One example is seen in Decision Number 81/Pdt.Sus-PKPU/2022/PN.Niaga Sby involving PT. MBM, where the settlement agreement ratified on February 17, 2023, has the potential to be improperly implemented. The purpose of this study is to analyze the legal impact on concurrent creditors if the debtor defaults and to examine available legal protections. The study uses a normative juridical method with a statutory, case-based, and conceptual approach, and draws on primary, secondary, and tertiary legal materials. The results show that debtor default places concurrent creditors in a weak position because they lack specific collateral rights. Legal protection can be achieved through the cancellation of the settlement agreement as stipulated in Article 291 of Law No. 37 of 2004, which resulted in the debtor being declared bankrupt. However, concurrent creditors remain vulnerable because payment priority is given to secured and preferred creditors. Keywords: Legal Protection, Concurrent Creditors, PKPU, Settlement Agreement
