Abstract
Abuse of authority is an important issue in administrative law, which occurs when officials exercise their powers inconsistently with the purposes of legislation, whether for personal or group interests. This study analyzes the abuse of authority committed by the Regent of Malang in issuing an Administrative Decree (KTUN) that disadvantaged the Head of the Malang Regency Health Office. The decree stated that the Head of the Health Office was released from their position for 12 months and reassigned to a staff position. The decision subsequently became the object of dispute in two court rulings, as the Head of the Health Office pursued legal remedies by filing a lawsuit with the Surabaya Administrative Court (PTUN) and an appeal with the Surabaya Administrative High Court (PTTUN). This study also examines that the abuse of authority committed by the Regent constitutes an arbitrary act as referred to in Article 17 paragraph (2) letter c of Law No. 30 of 2014, namely the exercise of authority without objective and rational grounds. The analysis reveals differences in the application of the general principles of good governance, where Decision No. 98/G/2024/PTUN.SBY declared the decree lawful, while the appellate Decision No.11/B/2025/PT.TUN.SBY emphasized substantive justice and the social impact on society.
