Abstract

A wali adhal (guardian in marriage) is a marriage guardian who refuses to marry a woman under his/her guardianship without a valid reason, thus impeding the woman's right to marry. This problem is resolved through the appointment of a guardian by the Religious Court based on the woman's request. This research uses an empirical legal approach, collecting data through interviews, observation, and document study in case No. 410/Pdt.P/2024/PA.Jbg. The results show that the implementation of the appointment of a wali adhal in the Jombang Religious Court has increased annually, caused by various factors such as differences in social status and economic status, Javanese customs, and the guardian's personal grudges. Obstacles encountered include limited public understanding of law and administrative obstacles in the trial process. Nevertheless, the Jombang Religious Court has implemented various efforts, such as improving information services, legal assistance through legal counseling posts (Posbakum), and optimizing case registration procedures.
