Abstract
Jurisdiction constitutes a form of exception frequently encountered in legal disputes, particularly in civil cases. It serves to establish whether a court possesses the legal competence to hear and adjudicate a matter. This research was initiated in response to the inconsistencies found in the application of legal principles by law enforcement authorities in Indonesia, especially judges, when determining the absolute competence of a judicial body. The study employs a normative juridical method, utilizing a statutory approach grounded in Indonesian laws and regulations, supplemented by a case study approach drawn from comparable judicial decisions, as well as a conceptual approach focusing on jurisdiction, unlawful acts (PMH), lawsuits, and government institutions. The primary objective of this research is to identify the legal elements involved in the dispute, particularly concerning the government institution that was sued for liability arising from the alleged tort, and to examine the application of the law in accordance with statutory provisions. The findings of this research lead to two main conclusions: first, the government institution in question cannot be held liable for PMH, as the essential elements required by the relevant legal provision are not fulfilled; and second, notwithstanding the absence of those elements, the panel of judges at the Central Jakarta District Court (PN Jakarta Pusat) must declare their lack of jurisdiction to hear, adjudicate, and render a decision in the case, as such competence falls within the jurisdiction of the Jakarta Administrative Court (PTUN Jakarta).
