Abstract

This study examines the liability of the developer of Diamond Village Juanda (DVJ) Housing, Sidoarjo Regency, for breach of contract in the Sale and Purchase Agreement (PPJB) and the legal remedies available to buyers for the losses incurred. This research is motivated by the often unbalanced position of developers in the drafting of PPJBs, one example of which occurred in the DVJ Housing PPJB, where the developer did not comply with applicable regulations, did not provide clear information to buyers, and did not fulfill its obligations in the PPJB. This study aims to analyze the liability of developers for breach of the PPJB and analyze the legal remedies available to buyers for the losses incurred. The research method used is normative juridical through a legislative, case study, and normative approach. The research is based on UU No 8/1999, UU No. 1/2011, UU No. 6/2023, and PP No. 12/2021, and is supported by previous research. The results of the study show that the developer has defaulted in the form of not performing at all and the liability that can be imposed on the developer is in the form of compensation for losses and cancellation of the agreement. Buyers can take non-litigation legal action through the BPSK or litigation through the courts in the form of a simple lawsuit or civil lawsuit.
