Abstract
Peer-to-Peer Lending Services Based on Technology (LPBBTI) have been rapidly growing in Indonesia but have raised new legal issues related to the protection of personal data, particularly concerning debtors. This research aims to analyze the application of civil law principles in safeguarding the rights and obligations of the parties as well as the legal consequences arising from loan agreements, especially regarding the management of personal data. The research method employed is normative juridical, using both statutory and conceptual approaches. The findings indicate a weakening in the implementation of fundamental legal principles and a regulatory disharmony between the Financial Services Authority Regulation No. 40 of 2024 (POJK 40/2024) and Law No. 27 of 2022 on Personal Data Protection (PDP Law), which may create legal uncertainty for the parties involved. The conclusion highlights the importance of regulatory harmonization and the reinforcement of principles governing loan agreements in the Indonesian Civil Code, namely the principles of freedom of contract, pacta sunt servanda, good faith, consensualism, and proportionality. Furthermore, the adoption of the data minimization principle from the General Data Protection Regulation (GDPR) is deemed essential to ensure effective legal remedies and protection for data subjects, particularly debtors.
