Abstract

Human trafficking is a criminal act involving the movement or control of individuals illegally for the purpose of severe exploitation. Domestic workers whose legal status is not explicitly regulated in the national legal system are vulnerable to exploitation and human trafficking. This is in contrast to the Philippines, which has fully recognized and protected children working as domestic workers in Republic Act No. 10364. This study aims to compare the laws and regulations of the two countries in protecting children who work as domestic workers against human trafficking and future legal arrangements to protect domestic worker children from human trafficking in Indonesia. The research method used is normative legal research with a comparative approach, a legislative approach, and a conceptual approach. The theory used in this study is the theory of legal protection. This study concludes that there are significant differences in the recognition of children as domestic workers, the fulfillment of the elements of human trafficking, and differences in the imposition of criminal penalties. Additionally, there are two options for future legal regulations to protect child domestic workers from human trafficking: a total ban on children working as domestic workers, or allowing children of a certain age to work as domestic workers, based on the provisions of Republic Act No. 10361 and Republic Act No. 10364.
