Abstract
The legal issue discussed in this study concerns journalists who are subject to criminal sanctions under Article 27 paragraph (3) UU ITE 2008 and UU ITE 2016 for their journalistic work published through digital media. This is paradoxical, as Article 15 paragraph (2) letter d UU Pers stipulates that the Press Council (Dewan Pers) is the authority responsible for handling matters related to press reporting. The current prevalence of press activities conducted through digital media has created a dilemma regarding the primary legal reference between the UU Pers and UU ITE 2008 and UU ITE 2016. Although a Joint Decree on the ITE Law (SKB UU ITE 2021) was issued in 2021, affirming theUU Pers as lex specialis, the conflict persists. The objectives of this research are to analyze the scope of the UU Pers and the UU ITE 2008 and UU ITE 2016 in accommodating the development of digital media within Indonesia's legal system, and to construct a legal analysis of the application of legal harmonization principles between the two laws to support press freedom in the digital era. This study employs a normative juridical research method, utilizing statutory and conceptual approaches. The findings indicate that theUU Pers and the UU ITE 2008 and UU ITE 2016 are inadequate in fully accommodating the rapid development of digital media within the Indonesian legal system. There is a normative conflict between the two laws, specifically between Article 15 paragraph (2) letter d of the UU Pers and Article 27 paragraph (3) of the UU ITE 2008 and UU ITE 2016. Consequently, a horizontal legal harmonization is necessary. The study concludes that this harmonization does not require an amendment to the UU Pers. Instead, it is crucial to amend the UU ITE 2008 and UU ITE 2016 by adding an exception clause to Article 27 paragraph (3), specifically for journalistic products published via digital media.
