Abstract

IMPLEMENTATION OF CRIMINAL SANCTIONS AGAINST RECIDIVISTS OF ONLINE GAMBLING CRIMES (CASE STUDY IN THE DISTRICT ATTORNEY'S OFFICE OF THE CITY OF KEDIRI) Abstract Online gambling crime is currently one of the rampant problems in Indonesia, especially in the jurisdiction of the Kediri City District Attorney's Office where illegal access to online gambling crime is due to the development of information technology that makes it easier for online gambling criminal offenders to commit violations. This research was made to analyze the provision of criminal sanctions against recidivists of online gambling crimes at the Kediri City District Attorney's Office. The method used is empirical juridical with analytical descriptive accompanied by qualitative data analysis where data is taken from interviews with the Kediri City District Attorney's Office. The study is carried out on the laws and regulations governing related criminal acts. The results of the study are used to determine the implementation of criminal sanctions against online gambling recidivists from the prosecution mechanism applied to online gambling offenders, especially recidivists, and how the form of aggravation of criminal sanctions imposed. Based on the data obtained, from a total of 73 online gambling criminal offenders, there are 19 recidivists with a percentage of 26.02%. The results of the study are used to show that the prosecution mechanism against recidivists basically follows the same process as the first offender, but there are differences in terms of imposing heavier sanctions. In addition, this research also aims to analyze the efforts of the Kediri City State Attorney's Office in preventing recidivism, both through repressive efforts in the form of punishment and guidance, as well as preventive efforts through collaboration between law enforcement agencies and legal education to the public. The findings show the importance of a comprehensive strategy in dealing with and preventing recidivism of online gambling crimes in a sustainable manner.
