Abstract

This study aims to analyze the legal implications of Constitutional Court Decision No. 70/PUU-XXII/2024 regarding the age limit provisions for regional head candidates and review its legal considerations from a constitutional perspective. The legal issue stems from the Supreme Court's interpretation that states that the age limit for candidates is calculated from the inauguration, which creates legal uncertainty in the implementation of the 2024 Regional Elections. To address this issue, the Constitutional Court, through Decision No. 70/PUU-XXII/2024, emphasized that the age limit for regional head candidates must be met at the stage of determining candidate pairs. This study uses a normative juridical type with a statutory, conceptual, and historical approach. This study uses secondary data obtained through library research. This study applies a qualitative data analysis method that forms descriptive data. The results of this study indicate that the a quo decision, which is final and binding, has implications for adjusting technical regulations by the General Elections Commission (KPU), as well as the cancellation of conflicting legislative provisions. From a constitutional perspective, the Constitutional Court Decision strengthens the principles of constitutional supremacy and the principle of checks and balances.
