Abstract
ABSTRACT: Diversion, based on Article 1 paragraph (7) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, is "the transfer of the settlement of a child's case from the criminal prosecution process to a process outside of criminal prosecution." The concept of diversion is based on persuasive actions, namely providing the perpetrator with the opportunity to change. Diversion must be pursued by all law enforcement officers, including at the understanding stage. Diversity in the implementation of juvenile cases is a form of providing rights for children. Currently, cases of assault committed by children at the Jombang District Attorney's Office in the last 3 (three) years have reached 40 cases. However, at the Jombang District Attorney's Office, diversion was only attempted in 1 case. One of the cases that was successfully diverted was a case with case registration PDM./89/M.5.25/VI/2024. The Jombang District Attorney's Office struggled to pursue diversion due to several obstacles, including the short timeframe, the difficulty of bringing the parties together, and the victim's reluctance to pursue diversion. To address these challenges, the Jombang District Attorney's Office has proposed several solutions, including time management, seeking assistance from village officials/local police, and educating relevant parties about the mandate of the Juvenile Criminal Justice System Law, which requires juvenile delinquency to be diverted.
