Abstract
This study examines the implementation of marriage, which should be carried out in accordance with the prevailing laws and regulations and current marriage law in Indonesia, through a case analysis based on the decision of the West Jakarta District Court No. 560/Pdt.P/2021/PN.Jkt.Brt.The research employs a normative juridical approach to assist in analyzing the issues. This study aims to comprehensively assess the issue of unregistered (under-the-table) marriages in the context of existing legal regulations. The results of the study show that the judge provided substantive justice but lacked a clear legal framework in determining the case. Legal system reform is necessary to provide clear guidelines that align with current societal conditions so that judges can deliver substantive justice and benefits without disregarding existing laws. The public must increase their legal awareness regarding marriage registration to ensure their rights to legal protection in family life and to avoid future risks.
