Abstract

Restorative justice is a conflict resolution approach focused on peace and restoring rights between the involved parties. According to Attorney General Regulation No. 15 of 2020 (PERJA NO.15 Tahun 2020), prosecutors have the authority to terminate prosecution based on the opportunity principle, as long as it fulfills justice, public interest, proportionality, and efficiency. This research aims to examine the implementation of restorative justice at the District Attorney’s Office of Malang Regency, particularly in embezzlement cases. Using an empirical juridical method, the study compares actual practices with existing regulations, supported by literature review, observation, and interviews. Two embezzlement cases were analyzed to understand why prosecutors decided to set aside certain restorative justice requirements. The study found several challenges, including victims' reluctance to forgive, excessive demands, and limited facilities. To address these issues, the Malang District Attorney’s Office has coordinated with stakeholders, assessed the feasibility of restorative conditions, and utilized restorative justice houses in subdistricts.
