Abstract
Corruption crimes cause huge losses to the state, but the asset forfeiture mechanism in Indonesia is only an additional punishment. Because the legal process to reach a criminal verdict takes a long time, this opens up opportunities for assets to be transferred, transferred, or disguised. This situation naturally increases the difficulty of identifying and determining the total extent of the state's financial losses. The author aims to analyze this loophole and seek solutions for asset forfeiture without criminal conviction to recover the state's financial losses. This research adopts a legal-normative approach based on legal principles and the harmonization of regulatory frameworks. Non-Conviction Based Asset Forfeiture (NCBAF) is an effective solution for seizing assets without waiting for criminal prosecution, especially when the perpetrator has fled, died, has legal immunity, or the assets have been transferred to a third party. Comparative studies with the United States and Thailand show that NCBAF is systematically applied through a legal framework, institutional structure, and structured procedures. Therefore, the refinement and enactment of the Asset Forfeiture Bill are crucial to strengthen the recovery of state financial losses through modern and progressive legal mechanisms.
