Abstract

The rapid development of Artificial Intelligence (AI), particularly Deepfake technology, has significantly impacted various sectors, including the field of law. Deepfake enables the realistic manipulation of visual and audio content, which raises serious concerns over its misuse—such as fraud, defamation, misinformation, and even digital pornography. This study aims to analyze the extent to which Indonesia's current legal regulations, especially criminal law, address the misuse of Deepfake technology. The research adopts a normative juridical method, employing statutory, conceptual, and case study approaches. The findings reveal that Indonesia has not yet established specific laws that directly regulate Deepfake. However, several provisions in Law No. 11 of 2008 concerning Electronic Information and Transactions (ITE Law), as well as the Personal Data Protection Law, can be used as a legal basis to prosecute offenders. This study concludes that there is an urgent need to establish more concrete and specific legal frameworks regarding AI and Deepfake, to ensure legal certainty and adequate protection for victims. The researcher recommends the formulation of special regulations to govern the ethical use and criminal liability of Deepfake technology in the digital era.
