Abstract
This research aims to examine the validity of Non-Fungible Tokens (NFTs) as objects and objects of collateral in the civil level and Intellectual Property Rights with a focus on their relevance to Government Regulation Number 24 of 2022. The urgency of this research is based on the Research Firm and Market projecting that the growth of NFTs in Indonesia will surge steadily with Compounded Annual Growth Rate (CAGR) of 35.8% in the period 2022-2028, jumping from a transaction value of $2.4 million USD (Rp38 billion) to $13 billion USD (Rp200 trillion). This phenomenon is reinforced by the reality of NFT market capitalization such as the Karafuru project worth IDR 1.2 trillion (2024) and digital works worth 30 Ethereum per collection, which contrasts with the unclear regulations related to the legal status of NFTs in Indonesia. The research method uses a normative juridical approach to evaluate the potential integration of NFTs in the property security system, while assessing the existing legal gaps. The results indicate that although NFTs can conceptually be qualified as objects and pledged through a property guarantee scheme and based on the scheme of Government Regulation Number 24 of 2022, their implementation still requires more comprehensive regulatory adjustments to accommodate the unique characteristics of NFTs as intellectual property in the form of digital assets. These findings highlight the urgency of legal reform to ensure legal certainty and protection for parties in NFT-based collateral transactions.
