Abstract

The development of information technology has encouraged innovation in the legal world, one of which is the use of electronic signatures in making notarial deeds. This study aims to analyze the validity of authentic deeds made using electronic signatures and the form of their evidentiary power from a cyber notary perspective based on the Indonesian legal system. The research method used is normative juridical with a statutory and conceptual approach, supported by primary and secondary legal materials. The results of the study show that although the Notary Law does not explicitly regulate the use of electronic signatures, through harmonization with the Electronic Information and Transactions Law and Government Regulation Number 71 of 2019, electronic signatures can be recognized as valid as long as they meet the legal requirements as stipulated in the provisions of the law. Certified electronic signatures have legal force and legal consequences and can be equated with conventional signatures. However, the use of uncertified electronic signatures in authentic deeds is still controversial and can result in the status of the deed as a private deed. This study concludes that the application of cyber notary, especially the use of electronic signatures in notarial deeds, is possible and needs to be supported by clearer and more comprehensive regulations. Explicit recognition is needed in the Notary Law to provide legal certainty for the use of technology in notarial practice.
