Abstract
A sale and purchase agreement is one of the most commonly encountered types of agreements in society and serves as a vital instrument in economic activity. It involves the exchange of goods or services mutually agreed upon by the parties involved. This study aims to analyze the validity of a sale and purchase agreement in which the price determination is made through a coin toss, within the context of Indonesian civil law. This thesis adopts a normative juridical research approach. The research includes an analysis of legal principles, legal systematics, and the synchronization of legal provisions related to the object of the study. A sale and purchase agreement that utilizes a coin toss to determine the price may still be considered valid, provided it fulfills the four essential legal requirements as stipulated in Article 1320 of the Indonesian Civil Code: mutual consent of the parties, legal capacity, a specific object, and a lawful cause. Although the coin toss method is random in nature, it does not eliminate the essential elements of the agreement, as both parties have consciously and voluntarily agreed to its use. The parties involved are legally competent, the object of the transaction is clear, and the method does not contravene the law, morality, or public order. Therefore, such an agreement retains its binding legal force. Keywords : Agreement; Coin Toss; Validity.
