Abstract
The 42nd ASEAN Summit, held on May 23, 2023, resulted in the adoption of the ASEAN Declaration on the Placement and Protection of Migrant Fishers. This declaration serves as a complementary framework to existing mechanisms, addressing a significant gap in ASEAN discussions, which have thus far primarily focused on land-based labor issues and have largely neglected the specific challenges faced by migrant fishers. This study focuses on Indonesia’s response to the ASEAN Declaration on the Placement and Protection of Migrant Fishers, particularly in the context of efforts to safeguard the rights and welfare of Indonesian migrant fishers. It is estimated that approximately 1.2 million Indonesian migrant workers are employed as crew members (ABK), with around 35,000 of them working on commercial fishing vessels. These workers often encounter a range of issues, including exploitative working conditions, abuse, occupational hazards, delayed wage payments, as well as complex recruitment procedures and contract bureaucracies. Given these challenges, this research is examined through the lens of national interest and international organization theories. The method employed in this study is descriptive in nature, utilizing literature review and secondary data analysis derived from existing records. The primary objective of this research is to identify and analyze the measures undertaken by the Indonesian government to ensure the protection and safety of Indonesian migrant workers.
