Abstract

The purpose of this research is to find out how the legal protection of civil servants ordered by superiors in carrying out their duties. This study uses a type of normative juridical research with a qualitative descriptive analysis method. This method allows the processing of primary and secondary data and then explains the data of the research results that the researcher conducts referring to the applicable legal rules in Indonesia by paying attention to the problems that will be made in a descriptive form. The results of the study show that the legal protection of civil servants who are designated as convicted of corruption in carrying out the orders of their superiors is in accordance with the decision that has been determined, but there are still several things that cause inconsistencies with procedures and provide problems in the case that cause an imbalance in the rights of employees and superiors. This shows that the employee does not have the authority to refuse the orders of the superior.
