Abstract

This study discusses legal protection for child victims of sexual intercourse with a case study of Decision Number 1619/Pid.Sus/2023/PN.Sby. Children as vulnerable legal subjects need optimal protection from the state, especially in sexual crimes that can have physical and psychological traumatic impacts. This study examines the application of the law in the decision and the form of legal protection provided to child victims. The research method uses a normative approach with primary, secondary, and tertiary legal sources. The results of the analysis show that the judge's decision has fulfilled the formal and material elements, but legal protection for victims in the form of psychological rehabilitation, legal assistance, and restitution has not been maximized, especially because the victim's guardian refused further intervention from the Regional Technical Implementation Unit for the Protection of Women and Children (PPA). Regulatory barriers and cultural practices such as obstruction by parents and the tradition of marrying perpetrators to victims also hinder the effectiveness of protection. Therefore, stricter regulations and education for the community are needed, as well as an increase in the role of the state to ensure that the rights of child victims are fully fulfilled.
