Abstract

This research aims to analyze the implementation of name change applications at the Surabaya District Court, specifically related to whether the determination issued by the panel of judges has met the applicable rules, as well as the legal consequences of name corrections in the Identity Card (KTP) and Family Card (KK) without prior changes in the Birth Certificate. This research uses a juridical-empirical method with a descriptive-analytical approach. Data were obtained through literature study, laws and regulations, and interviews with judges, court officials, and applicants. The results showed that most of the name change decisions in Surabaya District Court were in accordance with the regulations, but there were still errors in several decisions that only ordered changes to the KTP and KK without ordering changes to the Birth Certificate. This causes legal consequences in the form of unsynchronized population data, potential administrative disputes, and non-recognition of these changes in the national population administration system. This study recommends that every name change decision always orders changes to the Birth Certificate as the main source document to ensure legal certainty and administrative order.
