Abstract

General elections are a constitutional mechanism held every five years to elect representatives, including members of the Regional People's Representative Council, as regulated in the 1945 Constitution of the Republic of Indonesia and Law Number 7 of 2017. One of the main challenges in implementing general elections is the practice of money politics, which is categorized as an electoral crime. This research addresses the classification and law enforcement of money politics crimes in the 2024 Regional People's Representative Council elections in Surabaya City. Using empirical legal research methods and the theory of law enforcement, this study examines the das sollen and das sein aspects in handling cases by the Election Supervisory Body of Surabaya City. The results indicate that money politics occurred during three phases: the campaign period, the quiet period, and election day, with five reports received by the Election Supervisory Body of Surabaya City. All reports were dismissed due to the absence of legal subject elements, actions, and intent, as well as the unclear identity of the perpetrators. Law enforcement was carried out based on the Criminal Procedure Code, Law Number 7 of 2017, Regulation of the Election Supervisory Body Number 3 of 2023, and Regulation of the Election Supervisory Body Number 7 of 2022. The main obstacles in law enforcement include five factors: legal substance, law enforcement officers, infrastructure, society, and culture. This research recommends education to improve the quality of reports, strengthen supervision and prevention measures, and enhance the recruitment system of human resources based on competence.
