Abstract

In an era of globalization and increasingly intense business competition, legal protection of trademarks has become a crucial aspect for trademark owners to safeguard their exclusive rights. This study aims to analyze the legal standing of the trademark holder of "Strong" based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications, and to examine the legal considerations applied in Decision Number 30/Pdt.Sus-HKI/Merek/2020/PN Jkt.Pst. The research employs a normative juridical method with a statutory and case approach. Data were collected through literature studies and analysis of court decisions related to the trademark dispute over "Strong" between Hardwood Private Limited and PT Unilever Indonesia, Tbk. The findings indicate that under the first-to-file principle stipulated in the Trademark Law, the party who first registers a trademark is granted exclusive rights to that mark. However, in practice, other considerations may influence trademark ownership, such as substantial similarity and the reputation of a widely recognized brand. The court's ruling in this case illustrates how trademark law in Indonesia is implemented in resolving ownership disputes involving similar marks. This study is expected to provide further insight into the legal protection afforded to trademark holders and offer valuable perspectives for business actors in anticipating potential trademark disputes in Indonesia.
