Abstract
Misuse is the act of using something in an inappropriate or unlawful manner, which can harm oneself or others. This study aims to find out more clearly about the misuse of QRIS in digital banking transactions, assess whether the current legal system is effective enough to provide protection to customer users, and guarantee the security of transactions using QRIS, and whether strengthening regulations can reduce the risk of QRIS misuse, especially the implementation of the Banking Law in Indonesia to provide legal protection for customers in using QRIS. QRIS as an electronic payment system based on a QR code standardized by Bank Indonesia, is part of a digital banking transaction that provides convenience for transactions. However, along with the increasing use of electronic payment systems, there is also the potential for misuse of QRIS which can harm customer users. This research will be reviewed in a juridical-normative manner, a general review of banking Law Number 7 of 1992, Law Number 10 of 1998 and a specific review of the Regulation of the Member of the Board of Governors 21/18/2019 concerning the implementation of the national QR Code standard for payments. The number of users of electronic payment systems is increasing and the technology used is increasingly developing, but existing regulations are often not fully able to protect users from misuse of QRIS, which leads to criminal acts and causes losses. The results of this study are expected to provide recommendations to improve and perfect regulations related to digital banking transactions in Indonesia.
