Abstract
BPRS as an extension of Islamic banks distributes funds to customers which begins with making a contract to provide financing facilities so that it creates an obligation for customers as debtors to make financing repayments. Suppose it is found that the debtor is negligent or defaults, BPRS X Krian Branch takes legal remedies by the bank itself in the form of persuasive collection efforts, mediation, and financing restructuring. The bank also makes litigation legal efforts by registering a simple lawsuit with the PA. If the two options do not provide favorable results for both parties, the transfer of receivables through cessie becomes the last option by BPRS X Krian Branch in rescuing non-performing financing. There are two formulations of this research, namely (1) Application of the Cessie Scheme in the settlement of non-performing financing at BPRS X Krian Branch and (2) Legal Effects after the Implementation of Cessie to Debtors, Old Creditors, and new Creditors. This is empirical legal research with primary data sources in the form of interviews analyzed using a qualitative approach. The result of this research is that the cessie process at BPRS X Krian Branch has fulfilled the elements of Article 613 of the Civil Code by binding the parties as outlined in an authentic deed before a notary and notified in writing to the debtor to cause legal consequences.
