Abstract

Binturong protected wildlife trade can have a negative impact and can disrupt the balance of the ecosystem, because Binturong also has its role as an animal in maintaining the balance of its habitat ecosystem. The act of trading protected Binturong means committing a criminal offense regulated by Law Number 5 of 1990, because the status of Binturong as a protected animal has been regulated in the Legislation. This study intends to explore two problem formulations regarding the trade in protected wildlife Binturong, namely the first to explore the elements that can bring the buyer in the transaction can also be declared as a criminal offender, then the second is to explore the application of criminal sanctions against perpetrators of criminal acts of protected wildlife trade Binturong which until now has not been able to provide a deterrent effect in the perpetrators of criminal acts. This research uses empirical juridical methods or known as field research, with data collection methods carried out through direct observation and interviews with the object of the East Java Regional Police. The results obtained from this research are that changes need to be made to Law Number 5 of 1990, especially in the criminal sanctions section and efforts to overcome the obstacles that arise.
