Abstract
Women are quite often victims of sexual crimes such as rape that leads to pregnancy because women are classified as weak creatures. Rape as a form of sexual violence not only damages the victim's physical condition, but also has a profound psychological impact. This study aims to analyze the provision of protection and rights to victims of rape that cause pregnancy in the Indonesian legal system based on the Criminal Code (KUHP) and Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS). The research method used uses an empirical research approach by analyzing relevant laws and regulations in providing protection to victims of rape that causes pregnancy. In this legal research, empirical legal materials that can be used include the Criminal Code (KUHP) and Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS). The results of the study show that the protection received by the victim is protection of the victim's identity, protection of the victim's privacy, legal assistance, physical protection, psychological recovery, and support services for the victim. The rights received by the victim are the right to justice, recovery, protection, the right to receive legal and psychological assistance and compensation. The conclusion in this study as a whole, although Law No. 12 of 2022 and the Criminal Code have provided sufficient legal basis for the protection and rights of rape victims resulting in pregnancy, it is still necessary to increase the capacity of law enforcement officers, as well as strengthen support for victims so that they get maximum protection and their rights and can undergo the recovery process optimally.
