Abstract

The crime of human trafficking has become a problem Completed National and International. Migrant workers often become human trafficking victims due to lack of information regarding safe migration. SBMI is one of the organizations that plays a role in fighting for aspirations, rights and interests of migrant workers and their families, including accompanying them in resolving problems during the work period in the placement country. Laborer Migrants who face problems often convey their complaints to SBMI in the hope of getting assistance. Deep problem boundaries thesis discussion regarding the implementation of assistance for TIP victims in the form of labor exploitation according to positive law in Indonesia, as well as obstacles and solutions in assisting human trafficking victims in the form of work exploitation. Author in compiled his research using empirical juridical research with statutory and conceptual approaches. The research results show that the SBMI Malang City assistance is based on case examples, in The assistance is provided until the victim returns to Indonesia. There is obstacles that come from external factors and internal factors from the victim be a cause of assistance until the stage where the victim reports the problem what he experienced. Obstacles that arise are like victims who get it threats, the perpetrator being abroad to internal factors of the victim such as tools the evidence they have is lacking, so victims are reluctant to extend and report the problem. Solutions to overcome existing obstacles with increasing cooperation with the Government to implement preventive efforts that involves the community.
