Abstract

The criminal act of threatening via electronic media in Indonesian criminal law is regulated in Article 45 paragraph (4) of Law Number 19 of 2016 concerning Electronic Information and Transactions. In the Criminal Code, threats are defined as actions intended to gain personal benefit for the perpetrator. This still looks at criminal acts of threats via electronic media from the perpetrator's side but has not seen it from the victim's side. because in its application if the victim does not fulfill the threat element as stated in Article 45 paragraph (4) of Law Number 19 of 2016 concerning Electronic Information and Transactions then the Defendant cannot be declared guilty. Meanwhile, the victim experienced worry and anxiety as a result of the threats made by the perpetrator. It is hoped that in the future there will be a classification of criminal acts of threats through electronic media in order to achieve community welfare.
