Abstract

The legal impact of the change in creditor status from concurrent to preferred in the context of Suspension of Debt Payment Obligations (PKPU) and bankruptcy, particularly regarding the BANI arbitration decision in the case of PT. Tatamulia Nusantara Indah, is the main focus of this analysis. This study evaluates the validity of the legal basis for the arbitration decision that affects creditor status and its implications for the parties involved, such as creditors and debtors, through an empirical approach. In the processes of PKPU and bankruptcy, changes in creditor status can influence the priority of debt repayment and provide legal certainty. However, the arbitration decisions that underlie these changes often lead to legal uncertainty and potential disputes. The analysis includes an examination of legal regulations, case studies, and interviews with curators, legal consultants, and advocates. The findings indicate that arbitration decisions frequently lack a clear legal basis, resulting in pressure on concurrent creditors and an increased burden of obligations for the debtor. It is recommended that changes in creditor status based on arbitration decisions should only be made with a strong and transparent legal foundation to ensure justice and legal certainty.
