Abstract
Debt-incurring agreements with salt pond collateral, as conducted by the people of Pamekasan Regency, is a common practice. In the process of debt-incurring agreements that use salt ponds as collateral, it is often utilized by the people of Pamekasan Regency. The process of debt-incurring agreements with salt pond collateral is done in two forms, namely written and unwritten (oral) agreements. The majority of people in Pamekasan Regency use unwritten agreements, however, these unwritten agreements often lead to problems that frequently disadvantage one party. From the existing problems, the author conducted research and obtained problem formulations, among others, regarding the validity of debt-incurring agreements with salt pond collateral and legal efforts in the event of breach of contract for the disadvantaged party. The author's research uses a juridical-normative legal methodology with a conceptual approach and a case study approach. The civil aspect in the dispute of debt-incurring agreements is that there are losses experienced by the creditor due to the non-fulfillment of the debtor's performance. The creditor has the right to demand that the debtor fulfill/perform their obligation, if the debtor still does not fulfill/perform their obligation, then the creditor will take remedial action. In debt-incurring agreements with salt pond collateral that are made through unwritten agreements, it can be done through litigation or non-litigation, but most people prefer non-litigation settlement through mediation (family).
