Abstract
Along with the current rapid economic development, causing a renewal of the object of debt guarantee. One of them is the use of Purchase order as an object of debt guarantee. In this study using normative juridical method with data collection and management methods using library research technique or literature study. Purchase order as a guarantee object Accounts payable in terms of positive Indonesian law are acceptable. When viewed from Indonesian positive law, the purchase order is included in the guarantee category fiduciary as its binding as stipulated in Article 9 paragraph 1 Law Number 42 of 1999 concerning Fiduciary. Purchase orders are movable objects such as receivables which are commercial documents as collateral. Based on the results of existing research according to the field, it was also found that the form of a fictitious purchase order that is a fake Purchase order is a letter of order unreal or illegitimate purchases. Purchase orders made by buyers or the vendor is not real or not genuine so it is not true. Refers to Article 1320 of the Civil Code the object that is guaranteed is fictitious so that the legal consequences than the debt agreement, it is null and void and can be be accounted for by suing on the basis of the PMH lawsuit (Deeds) against the law), in addition to the purchase order which is used as an object of guarantee If it is fictitious, it can also be a criminal domain.
