Abstract
Writing this Legal Thesis aims to find out the basis of the judge's judgment, the judge's reasons, in imposing criminal sanctions below this specific minimal. Researchers in preparing this thesis use empirical juridical research methods by examining the applicable legal provisions and what is happening in the community, as well as looking for examples of sanction decisions below this minimal. This researcher aims to find out how much the judge uses SEMA NO. 3 of 20115 as a basis for consideration.
