Abstract
In this day and age, many people borrow and borrow money for business capital in order to meet their needs. Because This loan is for business capital, meaning that the repayment is accompanied by: interest or profits from the business carried out. Most of the payments installments by the debtor in accordance with a predetermined time agreement. In In this case, the default is carried out by the debtor because it is late in carrying out achievements, but the debtor actually sues the creditor whose capacity is as follows: capital owners. The basis of the lawsuit used by the debtor is a lawsuit debts and receivables. The purpose of this study is to analyze the contents of the lawsuit submitted by the debtor in case No. 92/Pdt.G/2016/PN SDA and analyze the judge's considerations in deciding the case No. 92.Pdt.G/2016/PN SDA. The research method used in this study is juridical normative. This research was conducted at the attorney's office "Mahajaya" Law Firm" Surabaya. The results of this study are (1) As a result of the existence of a lawsuit that filed by the debtor causes a defect in the lawsuit, namely a lawsuit becomes unclear and the suit becomes imperfect. Unclear lawsuit and imperfect by the Court is still accepted because the Court may not refuse to examine, hear and decide cases. (2) Judges consider the contents of the lawsuit because the plaintiff's claim is unclear and imperfect, and also taking into account the evidence and witnesses submitted by each party in court.
