Abstract
This thesis aims to determine the legal protection for patent holder simple billboard on a motorcycle where the patent is simple plagiarized by PT. X. This research uses the juridical method normative using descriptive analysis in processing data with the approach qualitative method to determine the content and meaning of the purpose of a rule of law in order to be used as a reference in solving a legal problem that becomes a study object. The results of this study that PT. X has done plagiarism against a simple patent on a motorcycle billboard where PT. X violates exclusive rights without the consent of the simple patent holder. There are 2 types of legal protection for simple patent holders. first, Preventive legal protection is an effort to prevent before violation occurs. second, repressive legal protection, namely forcing to resolve violations in a dispute which can provide sanctions for violators. Legal remedies that can be taken by patent holders There are 2 simple ways, namely by non-litigation or litigation. Keywords: Patent Rights, Plagiarism, Legal Protection
