Abstract
The successful implementation of the execution of the mortgage right through a complete auction until the execution of the discharge is the hope of all applicants for execution, but it is unavoidable if there are parties to fight because they feel disadvantaged over the implementation of the execution of the mortgage. Resistance to execution can occur when the party being executed or a third party feels that the action is unfair, so they try to defend the object. The purpose of this paper is to determine the legal position of the auction winner who received resistance from a third party (derden verzet).This study used a normative juridical method, with a qualitative approach.This writing It uses a legislative approach and a conceptual approach to the execution of a third-party opposition object (derden verzet). The results of this paper indicate that a person who bids the highest on an auction item and has been authorized by the auctioneer has a legal standing as the winner of the auction and the winner of the auction in good faith must be protected. For opponents who cannot prove the basis of ownership of the object of execution, they can be declared as opponents who are not right.
