Abstract

People with disabilities often get discriminatory treatment from various parties because their physical form is different from normal humans. Usually the perpetrators targeted the child witnesses of victims with disabilities because they were considered physically helpless, and it was likely that the victim-witnesses would have difficulty reporting because it was considered that the strength of their testimony could not ensnare the perpetrators of rape. The purpose of this study was to find out the strength of the evidence provided by witnesses to rape victims of children with disabilities at the investigative level and to find out what the inhibiting factors were for the police against child witnesses who were rape victims with disabilities during the investigation process by the Surabaya Polrestabes. In this study the authors used empirical or sociological legal methods using a qualitative approach. Based on the results of the research, it proves that the strength of the testimony of victims with disabilities is the same as other normal children as long as the witness has the quality of being a witness and is assisted by an interpreter and psychiatrist who is neutral and impartial. This is due to the quality of the witness, not the physical limitations of the witness. The inhibiting factor for the police towards witnesses victims with disabilities is that witnesses do not want to tell stories, and are proactive and difficult to control which results in delays in the investigation process, witnesses are not fluent in using sign language, and the unavailability of supporting facilities such as braille, (sign language translators), and refusal of persons with disabilities as a witness.
