Abstract

Indonesia is a country that the second ranks in the world as a producer of waste. This is inversely proportional to Indonesia which still imports hazardous waste from the United State on the grounds that it has passed procedures in accordance with Permendag No. 31 of 2016. However this is contrary to Basel Ban Amendments in Presidential Regulation No. 47 of 2005 concerning the ban on the import of hazardous waste from developed countries. In addition, Indonesia also implements a policy to re-export the United State’s waste which is considered aggressive. Therefore, this research is to answer the question why Indonesia reexports The United State's waste in 2005-2019 using the compliance theory by Ronald B. Mitchell juxtaposed with the securitization theory by Barry Buzan in analyzing the causal and basic policy influences the decision to re-export waste policies which are considered aggressive. Compliance theory explains the attitude taken by countries in implementing regulations in international treaties. While securitization theory explains the existence of issues that were not initially considered threatening, which are perceived by the public as a threatening problem because of the role of actors in discussing those issues that are influential and responded to with extraordinary measures. This research uses explanative and qualitative research with the scope of the study beginning in 2005 after the Presidential Regulation No. 47 of 2005 and ended in 2019 which is known to still re-export waste. Collecting is obtained by using secondary data (library research) and data analysis is done through process tracing to identify independent and independent variables (causal). This research found that Indonesia as a member of the Basel convention has tried to carry out its obligations by ratifying the Basel Convention Amendments. However, it has not been able to achieve this commitment, as evidenced by the existence of a regulation that contradicts the amendment to the Basel convention which has resulted in the import of hazardous waste from the United States as evidence of Indonesia's non-compliance based on the category of good faith non-complain. So that there is a discourse of the danger of importing waste to environmental and human security raised by environmental activists. This discourse has an effect on the extraordinary measures taken by Indonesia, namely the re-export of The United State waste which is considered aggressive. It is recommended that policy makers and stakeholders not only know to make the right decision but also must know to respond quickly when the decision made is wrong through a decision made right.
