Abstract
In writing this thesis, the author intends to find out regarding criminal sanctions for perpetrators of participation in the crime of abortion. In This study uses an empirical juridical method, namely research that combines legal materials (which are secondary data) with primary data that obtained in the field. Judges in the application of criminal sanctions for perpetrators of participating in the crime of abortion themselves compare the existence of the lightening and the aggravating things. Application of dropping Criminal sanctions for perpetrators of participation in the crime of abortion have several types: criminal elements include subjective elements and objective elements that become conditions are met in order to be considered a crime. The application of the imposition of criminal sanctions for perpetrators of participation in criminal acts This abortion must meet the elements so that it can be accounted for legally Criminal law is an element of error which is divided into two, namely the element of intent and elements of negligence. There are differences in the application of the imposition of criminal sanctions for perpetrators of participation in the crime of abortion due to the application of a crime that does not the same for the same crime.
