Abstract
Efforts to overcome street children, homeless people, beggars and children The street is one of the efforts to organize social order in order to realize safe and comfortable community environment. This research aims to identify and analyze implementation and constraints in implementation of Article 40 of Mojokerto City Regional Regulation Number 3 of 2013 concerning the Implementation of Public Order. This juridical empirical type of research using qualitative analysis methods that produce descriptive data analysis where the data obtained through observation, interviews and literature study. Implementation of Article 40 of Mojokerto City Regional Regulation Number 3 of 2013 consists of 3 (three) stages, namely raids, temporary shelters for selection and repatriation to the area of origin involving the Satpol PP and the Social Service. In analysis of its implementation there is a discrepancy between local regulations and implementation in the field, discrepancies in the data between the Social Service and the Unit Civil Service Police, raids are uneven, the need for attention to the region vulnerable because there are no guard posts and their implementation is not enough effective because it has not fulfilled the 5 (five) law enforcement factors to achieve legal effectiveness. The obstacles faced are the absence of SOPs / technical guidelines, poor administrative records, lack of Civil Service Police Unit personnel Praja, the level of legal awareness of the violators is low, the need for training interest in talent and the flow of urbanization of street children, homeless people, beggars, sufferers underdiagnosed mental disorders.
